I attempted to create the following list using the policy outlined under https://forum.audiogames.net/topic/4003 … set-theft/
It's not definitive, and I'd like others to weigh in with their opinions on the matter. This is why I made it public. I'd rather this whole thing be done by consensus, or at least as far of a consensus as we're able to reach, to make it at least a bit less painful for those involved. I know there's a lot of projects dear to the community in here, which people have put hours of work into (no, sounds aren't everything.) But if these rules are going to be in place, they'd better be in place correctly.
This is not a complete list, but these are the ones I'm pretty certain of, that majorly violate the new copyright rule. I tried to place emphasis on direct, easily provable cases of asset theft, like things taken straight from games, films, tv shows etc. Rather than the use of sound library content, which you can't prove without lengthy investigations.
Alter Aeon: All references and links to Mush Z should be removed. The most obvious reason for this is the giant music folder that comes with the soundpack, containing tracks from numerous games such as Mortal Kombat, Street Fighter, and possibly some final fantasy games. Many of the sounds are equally questionable as to their origin.
1: Final Fantasy XII.
The following found on OST (video link):
https://www.youtube.com/watch?v=Tgd9ajyAiIs
A: 00:36:43.
Found at: mush z\worlds\alteraeon\sounds\notifications\betterat\27.ogg
b: 00:42:38
Found at: mush z\worlds\alteraeon\sounds\music\area\You are in the precinct of an ancient crypt on the island of Kordan..ogg
c: 51:33
Found at: mush z\worlds\alteraeon\sounds\music\area\The edge of the southern desert.ogg
2: Super Street Fighter IV.
https://www.youtube.com/watch?v=hTD3LhS … p;index=30
Found at: mush z\worlds\alteraeon\sounds\music\area\samurais.ogg
3: Two steps from hell.
https://www.youtube.com/watch?v=d2hRTLdvdnk
Found at: mush z\worlds\alteraeon\sounds\music\area\global.ogg
And so it continues. I believe this amount of data should suffice for now.
Awesome homer: Many references to Simpsons characters, as well as sounds from the simpsons tv series. The Jim Kitchen games in general should be investigated particularly, especially relating to their intro songs. I didn't list all of them, because for some, I'm quite frankly not sure, and secondly I'm willing to give the benefit of the doubt to those I can't say anything about with confidence.
1: Simpson's theme song used. The game does not use the original version, but I have linked it here for comparing.
https://www.youtube.com/watch?v=Xqog63KOANc
Found at: Kitchen's Sink\awes0.wav (I installed the complete setup package for all of Kitchen's games so this is where it's at for me)
2: Example from the arcade game loops used in level 6. I used the pacman loop as an example.
https://www.youtube.com/watch?v=SPjEhbRFTUk
Found at: Kitchen's Sink\awes62.wav; Kitchen's Sink\awes81.wav
Baseball (jim kitchen): For the commercial breaks between innings, the game plays clips from old tv commercials. Asset lifting could have been practiced for other sounds too, but the commercials are the primary reason this is on the list.
1: ALMOND JOY COMMERCIAL
https://www.youtube.com/watch?v=5MOJAxformw
Found at: Kitchen's Sink\baseco4.wav
2: Cracker jack.
https://www.youtube.com/watch?v=xXDC7ZJLEWE
Found at: Kitchen's Sink\baseco5.wav
3: Mr. Clean.
https://www.youtube.com/watch?v=lBUMw3t6rIQ
Found at: Kitchen's Sink\baseco6.wav
I could continue on like this for a while, but I think we get it now ,don't we?
*Battle Zone used to be here. But I've got no proof, so poof it goes.*
Beatstar pro: User created soundpacks contain absolutely massive amounts of copyrighted music from various games, artists, and films. A lot of them are longer than 30 seconds, which negates any probability for fair use consideration. These packs can be downloaded by anyone if they have the game. Furthermore, the music files contained within are unencrypted and openly viewable once downloaded. Best example is the face the music pack series, each one of which containing 60+ sections of famous songs.
1: Abba - Dancing queen
https://www.youtube.com/watch?v=xFrGuyw1V8s
Fount at: D:\games\oriol\beatstar\packs\ABBA\6music.ogg
2: Alanis Morissette - Ironic (Chorus)
https://www.youtube.com/watch?v=Jne9t8sHpUc
Found at: D:\games\oriol\beatstar\packs\AlanisMorissette6music.ogg
3: Greenday - boulevard of broken dreams (verse 1)
https://www.youtube.com/watch?v=Soa3gO7tL-c
Found at: D:\games\oriol\beatstar\packs\blast_from_the_past\3music.ogg
And much, much more besides. I could probably fill the forum character limit with just beatstar examples.
*Candy crashers used to be here. Couldn't find a definitive list of scooby doo villains though, so it's gone until further notice.
Casino: Every game in the Jim kitchen's Casino collection has a copyrighted song assigned to it, such as Money by Pink Floyd or the Tina Turner version of Rollin' on the river.
1: Slot machine theme.
https://www.youtube.com/watch?v=-0kcet4aPpQ
Found at: Kitchen's Sink\casino24.wav
2: Craps theme (some time into the song).
https://www.youtube.com/watch?v=Uifuzx9TDVY
Found at: Kitchen's Sink\casino36.wav
Same goes for the other table themes.
Cosmic rage:
soundpacks referenced in database entry, should be removed because the cosmic rage experience for VIP contains tracks such as:
1: emperial march (Darth vader's theme).
https://www.youtube.com/watch?v=-bzWSJG93P8
Found at: Cosmic Rage\music\Combat\Theme1.wav
2: Star wars main theme.
https://www.youtube.com/watch?v=_D0ZQPqeJkk
Found at: Cosmic Rage\music\Combat\Theme7.wav
Crazy Party: A few sounds, but mostly music, was lifted from many games, such as the Mario Party, Pokemon, or Mario Cart franchises. Quite a few card names are also direct copies of Pokemon moves.
1: Battle level 3.
https://www.youtube.com/watch?v=qtzPna9yFjg
2: Mini game unlock area.
https://www.youtube.com/watch?v=OA_uujT … mp;index=3
3: Clocks of the village minigame.
https://www.youtube.com/watch?v=gjMVjCs … p;index=12
There's lots more where that came from. If you need more examples, just say so. I've got them practically lined up here.
*Damage extreme used to be here. But it's an entry that lacks sufficient evidence, so good bye for now.
Death on the road: Contains many vehicle sound loops that play clips from famous pop songs, such as Never gonna give you up or Alejandro.
All of these are car loops played by vehicles as they drive past.
1: Hey guys I just contacted every single intelectual property holder on earth at the same time and they've all agreed to let us use their stuff, no questions... aw fuck it, rickrolls are really, really old. Let's just continue.
Real 1: Rick Astley - Never gonna give you up
https://www.youtube.com/watch?v=dQw4w9WgXcQ
2: lady Gaga - Alejandro
https://www.youtube.com/watch?v=niqrrmev4mA
3: Andreas Bourani - Nur in meinem Kopf
https://www.youtube.com/watch?v=K2DHiyFdaSk
And there's more.
Duck hunt (sound location not given due to encription):
https://www.youtube.com/watch?v=7wZ3t4hi5T0
Practically all the original game's sounds are in here. I don't think this would require any precise sourcing.
ESP Pinball Classic: While the origins of some of the sound files are questionable, the dead giveaway for this game is the Pacman table, which contains most of the sounds from the Arcade game.
https://www.youtube.com/watch?v=SPjEhbRFTUk
Freedom Millionaire: Jingles, stingers, and background music taken from the Who Wants To Be A Millionaire game show.
Go to Millionaire\Standard.snd (that's my install directory at least) to find all the music files they used.
https://www.youtube.com/playlist?list=P … mpjWg5nbrG
*Homer On A Harley used to be here. IDK what the intro song is actually called though, so can't research the validity of copyright claims. Can't find the simpson quotes either.
Light Battles 1: Clash of light sabres: Sounds, music, and cannon from the Star wars Franchise.
1: star wars theme used as one of the logos.
https://www.youtube.com/watch?v=_D0ZQPqeJkk
2: Light sabre sounds during battle (please just compare game to video).
https://www.youtube.com/watch?v=_E_PSZa6GXs
Miriani: References and links to the soundpack are problematic because of sounds and battle music from Star trek.
1: Various Star Trek computer beeps.
https://www.youtube.com/watch?v=5qzEQwOcPtg
2: Theme music, I shall use theme 2 as an example, as it is widely known among Star Trek fans.
https://www.youtube.com/watch?v=e6wOwfrM880
Found at: Miriani Soundpack Sounds, version 6\Miriani Soundpack Sounds\Themes\Theme (2).mp3
Night of Parasite: Music from the resident evil series.
Resident evil tracks:
The following found on Soundtrack compelations (video link):
https://www.youtube.com/watch?v=3Ku4LWnTniE
1: 00:00:11
Found at: nop\music\gameover.mp3
2: 00:04:14
Found at: nop\music\js2.mp3
Pacman Talks: Direct lifting of the concept of the Pacman game, including its main concepts and sounds. The fact that this game is shareware makes the situation all the more problematic.
Uses most sounds from the game (sounds encripted).
https://www.youtube.com/watch?v=SPjEhbRFTUk
Rhythm rage: Level ideas and patterns partly taken directly from Rhythm Heaven games. Some music files also come from the rhythm heaven franchise. At least one track (Jago's memory level music) in the main soundpacks is taken from Killer Instinct and was lifted in full length.
1: Jago's theme for Jago's memory.
https://www.youtube.com/watch?v=loSj5Iy1OOs
2: Different heaven - Nekozilla (a shortened version) used without credit, which is required if using NCS material.
https://www.youtube.com/watch?v=6FNHe3kf8_s
3: Rhythm heaven feaver music used for the level Crewel Kings And Dying Men
https://www.youtube.com/watch?v=6FNHe3kf8_s
Feel free to roominate on these examples. I can provide more if you need them. Don't see why though. According to your policy, this is already too much.
Sarah and the castle of witchcraft and wizardry: Extensive use of the Harry Potter Cannon. I don't think this would be such a problem if the game were free, but it isn't, so on the list it goes, for now. There's probably people who know more about using non-original characters in commercial ways than I do on here. Please discuss.
Update: Sara has already been proven to be a valid claim do to charging for the use of Harry Potter cannon.
Star trek final conflict: Extensive use of Star trek music, sounds, and Cannon.
1: Varius Computer beep sounds (especially the first)
https://www.youtube.com/watch?v=5qzEQwOcPtg
2: Bridge sound.
https://www.youtube.com/watch?v=UKBvaOLDem0&t=839s
3: Federation Phasers.
https://www.youtube.com/watch?v=j5dVhLSdtlA
There's lots more here too if you want.
Super Mario Bros Audio edition: Music and sounds from the Super Mario franchise. I also believe Cae Jones claimed he tried to reconstruct the level layouts of the original game from memory, so this could be a problem, too.
I think the following videos speak for themselves, no file locations or anything like that needed.
Sounds: https://www.youtube.com/watch?v=5yrFdhNG2Sk
Music: https://www.youtube.com/watch?v=SB1VqLCTFpA
*Stw used to be here* (to provide context)
Tactical battle: Offers free downloads to map packs, some of which are either based on the Cannon of Star trek or Star wars with according use of the franchise's sounds and music, or directly taking Music tracks from films, such as in the zombie war map pack, which uses the halloween? theme.
Star wars and Star trek links have already been provided enough times in this post. See above for those. I will add one more thing specifically for TB though.
A variant of the halloween main theme used during the zombie house map.
https://www.youtube.com/watch?v=pT4FY3NrhGg
*Tarzan Junior used to be here. I know better now.
https://blogs.loc.gov/copyright/2019/01/publicdomain/#:~:text=Edgar%20Rice%20Burroughs'%20%E2%80%9CTarzan%20and,domain%20in%20the%20United%20States.&text=Public%20domain%20works%20are%20free,copyright%20protection%20to%20all%20works.
Tournament: Heavy use of music files, characters, and possibly move lists from fighting games such as Mortal Kombat or Street Fighter. The music files are low quality, but they sound like they're full length and clearly recognisable as taken from their respective games. Examples follow:
The following found on Street fighter II OST (video link):
https://www.youtube.com/watch?v=Ceedgl2wKbg
Ken's theme (in game):
00:07:12
Munawar's theme:
https://www.youtube.com/watch?v=LQw-a8s … B0A10F2FC6
Trek2000: Similar to Final Conflict, many sounds, and in Trek2000's case also speech files, taken from Star trek.
More of the same star trek computer sounds.
https://www.youtube.com/watch?v=5qzEQwOcPtg
Next, compare this:
https://www.youtube.com/watch?v=1ZXugicgn6U&t=53s
with these:
Trek\st10.wav
Trek\st11.wav
Trek\st12.wav
And so on.
Undead assault: Concepts, music, character voices, and sounds taken from the Call Of Duty franchise.
1: fire sail music.
https://www.youtube.com/watch?v=bOKL9qPm0rc
2: Quotes from COD zombies Kino Der Toten. I'm going to show you the Nikolai quotes as an example, but it's the same for all the other characters.
https://www.youtube.com/watch?v=AbFQSmHFeNU
Any more?
X- Wing Patrol: Star wars sounds and ship names.
I've got just one. But it says a lot. Plus that games doesn't even have many sounds to begin with.
https://www.youtube.com/watch?v=yhhR16xbErA
