2021-03-31 13:43:09 (edited by Dakonna 2021-04-01 01:26:09)

I attempted to create the following list using the policy outlined under https://forum.audiogames.net/topic/4003 … set-theft/
It's not definitive, and I'd like others to weigh in with their opinions on the matter. This is why I made it public. I'd rather this whole thing be done by consensus, or at least as far of a consensus as we're able to reach, to make it at least a bit less painful for those involved. I know there's a lot of projects dear to the community in here, which people have put hours of work into (no, sounds aren't everything.) But if these rules are going to be in place, they'd better be in place correctly.
This is not a complete list, but these are the ones I'm pretty certain of, that majorly violate the new copyright rule. I tried to place emphasis on direct, easily provable cases of asset theft, like things taken straight from games, films, tv shows etc. Rather than the use of sound library content, which you can't prove without lengthy investigations.
Alter Aeon: All references and links to Mush Z should be removed. The most obvious reason for this is the giant music folder that comes with the soundpack, containing tracks from numerous games such as Mortal Kombat, Street Fighter, and possibly some final fantasy games. Many of the sounds are equally questionable as to their origin.
1: Final Fantasy XII.
The following found on OST (video link):
https://www.youtube.com/watch?v=Tgd9ajyAiIs
A: 00:36:43.
Found at: mush z\worlds\alteraeon\sounds\notifications\betterat\27.ogg
b: 00:42:38
Found at: mush z\worlds\alteraeon\sounds\music\area\You are in the precinct of an ancient crypt on the island of Kordan..ogg
c: 51:33
Found at: mush z\worlds\alteraeon\sounds\music\area\The edge of the southern desert.ogg
2: Super Street Fighter IV.
https://www.youtube.com/watch?v=hTD3LhS … p;index=30
Found at: mush z\worlds\alteraeon\sounds\music\area\samurais.ogg
3: Two steps from hell.
https://www.youtube.com/watch?v=d2hRTLdvdnk
Found at: mush z\worlds\alteraeon\sounds\music\area\global.ogg
And so it continues. I believe this amount of data should suffice for now.
Awesome homer: Many references to Simpsons characters, as well as sounds from the simpsons tv series. The Jim Kitchen games in general should be investigated particularly, especially relating to their intro songs. I didn't list all of them, because for some, I'm quite frankly not sure, and secondly I'm willing to give the benefit of the doubt to those I can't say anything about with confidence.
1: Simpson's theme song used. The game does not use the original version, but I have linked it here for comparing.
https://www.youtube.com/watch?v=Xqog63KOANc
Found at: Kitchen's Sink\awes0.wav (I installed the complete setup package for all of Kitchen's games so this is where it's at for me)
2: Example from the arcade game loops used in level 6. I used the pacman loop as an example.
https://www.youtube.com/watch?v=SPjEhbRFTUk
Found at: Kitchen's Sink\awes62.wav; Kitchen's Sink\awes81.wav
Baseball (jim kitchen): For the commercial breaks between innings, the game plays clips from old tv commercials. Asset lifting could have been practiced for other sounds too, but the commercials are the primary reason this is on the list.
1: ALMOND JOY COMMERCIAL
https://www.youtube.com/watch?v=5MOJAxformw
Found at: Kitchen's Sink\baseco4.wav
2: Cracker jack.
https://www.youtube.com/watch?v=xXDC7ZJLEWE
Found at: Kitchen's Sink\baseco5.wav
3: Mr. Clean.
https://www.youtube.com/watch?v=lBUMw3t6rIQ
Found at: Kitchen's Sink\baseco6.wav
I could continue on like this for a while, but I think we get it now ,don't we?
*Battle Zone used to be here. But I've got no proof, so poof it goes.*
Beatstar pro: User created soundpacks contain absolutely massive amounts of copyrighted music from various games, artists, and films. A lot of them are longer than 30 seconds, which negates any probability for fair use consideration. These packs can be downloaded by anyone if they have the game. Furthermore, the music files contained within are unencrypted and openly viewable once downloaded. Best example is the face the music pack series, each one of which containing 60+ sections of famous songs.
1: Abba - Dancing queen
https://www.youtube.com/watch?v=xFrGuyw1V8s
Fount at: D:\games\oriol\beatstar\packs\ABBA\6music.ogg
2: Alanis Morissette - Ironic (Chorus)
https://www.youtube.com/watch?v=Jne9t8sHpUc
Found at: D:\games\oriol\beatstar\packs\AlanisMorissette6music.ogg
3: Greenday - boulevard of broken dreams (verse 1)
https://www.youtube.com/watch?v=Soa3gO7tL-c
Found at: D:\games\oriol\beatstar\packs\blast_from_the_past\3music.ogg
And much, much more besides. I could probably fill the forum character limit with just beatstar examples.
*Candy crashers used to be here. Couldn't find a definitive list of scooby doo villains though, so it's gone until further notice.
Casino: Every game in the Jim kitchen's Casino collection has a copyrighted song assigned to it, such as Money by Pink Floyd or the Tina Turner version of Rollin' on the river.
1: Slot machine theme.
https://www.youtube.com/watch?v=-0kcet4aPpQ
Found at: Kitchen's Sink\casino24.wav
2: Craps theme (some time into the song).
https://www.youtube.com/watch?v=Uifuzx9TDVY
Found at: Kitchen's Sink\casino36.wav
Same goes for the other table themes.
Cosmic rage:
soundpacks referenced in database entry, should be removed because the cosmic rage experience for VIP contains tracks such as:
1: emperial march (Darth vader's theme).
https://www.youtube.com/watch?v=-bzWSJG93P8
Found at: Cosmic Rage\music\Combat\Theme1.wav
2: Star wars main theme.
https://www.youtube.com/watch?v=_D0ZQPqeJkk
Found at: Cosmic Rage\music\Combat\Theme7.wav
Crazy Party: A few sounds, but mostly music, was lifted from many games, such as the Mario Party, Pokemon, or Mario Cart franchises. Quite a few card names are also direct copies of Pokemon moves.
1: Battle level 3.
https://www.youtube.com/watch?v=qtzPna9yFjg
2: Mini game unlock area.
https://www.youtube.com/watch?v=OA_uujT … mp;index=3
3: Clocks of the village minigame.
https://www.youtube.com/watch?v=gjMVjCs … p;index=12
There's lots more where that came from. If you need more examples, just say so. I've got them practically lined up here.
*Damage extreme used to be here. But it's an entry that lacks sufficient evidence, so good bye for now.
Death on the road: Contains many vehicle sound loops that play clips from famous pop songs, such as Never gonna give you up or Alejandro.
All of these are car loops played by vehicles as they drive past.
1: Hey guys I just contacted every single intelectual property holder on earth at the same time and they've all agreed to let us use their stuff, no questions... aw fuck it, rickrolls are really, really old. Let's just continue.
Real 1: Rick Astley - Never gonna give you up
https://www.youtube.com/watch?v=dQw4w9WgXcQ
2: lady Gaga - Alejandro
https://www.youtube.com/watch?v=niqrrmev4mA
3: Andreas Bourani - Nur in meinem Kopf
https://www.youtube.com/watch?v=K2DHiyFdaSk
And there's more.
Duck hunt (sound location not given due to encription):
https://www.youtube.com/watch?v=7wZ3t4hi5T0
Practically all the original game's sounds are in here. I don't think this would require any precise sourcing.
ESP Pinball Classic: While the origins of some of the sound files are questionable, the dead giveaway for this game is the Pacman table, which contains most of the sounds from the Arcade game.
https://www.youtube.com/watch?v=SPjEhbRFTUk
Freedom Millionaire: Jingles, stingers, and background music taken from the Who Wants To Be A Millionaire game show.
Go to Millionaire\Standard.snd (that's my install directory at least) to find all the music files they used.
https://www.youtube.com/playlist?list=P … mpjWg5nbrG

*Homer On A Harley used to be here. IDK what the intro song is actually called though, so can't research the validity of copyright claims. Can't find the simpson quotes either.
Light Battles 1: Clash of light sabres: Sounds, music, and cannon from the Star wars Franchise.
1: star wars theme used as one of the logos.
https://www.youtube.com/watch?v=_D0ZQPqeJkk
2: Light sabre sounds during battle (please just compare game to video).
https://www.youtube.com/watch?v=_E_PSZa6GXs
Miriani: References and links to the soundpack are problematic because of sounds and battle music from Star trek.
1: Various Star Trek computer beeps.
https://www.youtube.com/watch?v=5qzEQwOcPtg
2: Theme music, I shall use theme 2 as an example, as it is widely known among Star Trek fans.
https://www.youtube.com/watch?v=e6wOwfrM880
Found at: Miriani Soundpack Sounds, version 6\Miriani Soundpack Sounds\Themes\Theme (2).mp3
Night of Parasite: Music from the resident evil series.
Resident evil tracks:
The following found on Soundtrack compelations (video link):
https://www.youtube.com/watch?v=3Ku4LWnTniE
1: 00:00:11
Found at: nop\music\gameover.mp3
2: 00:04:14
Found at: nop\music\js2.mp3
Pacman Talks: Direct lifting of the concept of the Pacman game, including its main concepts and sounds. The fact that this game is shareware makes the situation all the more problematic.
Uses most sounds from the game (sounds encripted).
https://www.youtube.com/watch?v=SPjEhbRFTUk
Rhythm rage: Level ideas and patterns partly taken directly from Rhythm Heaven games. Some music files also come from the rhythm heaven franchise. At least one track (Jago's memory level music) in the main soundpacks is taken from Killer Instinct and was lifted in full length.
1: Jago's theme for Jago's memory.
https://www.youtube.com/watch?v=loSj5Iy1OOs
2: Different heaven - Nekozilla (a shortened version) used without credit, which is required if using NCS material.
https://www.youtube.com/watch?v=6FNHe3kf8_s
3: Rhythm heaven feaver music used for the level Crewel Kings And Dying Men
https://www.youtube.com/watch?v=6FNHe3kf8_s
Feel free to roominate on these examples. I can provide more if you need them. Don't see why though. According to your policy, this is already too much.

Sarah and the castle of witchcraft and wizardry: Extensive use of the Harry Potter Cannon. I don't think this would be such a problem if the game were free, but it isn't, so on the list it goes, for now. There's probably people who know more about using non-original characters in commercial ways than I do on here. Please discuss.
Update: Sara has already been proven to be a valid claim do to charging for the use of Harry Potter cannon.
Star trek final conflict: Extensive use of Star trek music, sounds, and Cannon.
1: Varius Computer beep sounds (especially the first)
https://www.youtube.com/watch?v=5qzEQwOcPtg
2: Bridge sound.
https://www.youtube.com/watch?v=UKBvaOLDem0&t=839s
3: Federation Phasers.
https://www.youtube.com/watch?v=j5dVhLSdtlA
There's lots more here too if you want.
Super Mario Bros Audio edition: Music and sounds from the Super Mario franchise. I also believe Cae Jones claimed he tried to reconstruct the level layouts of the original game from memory, so this could be a problem, too.
I think the following videos speak for themselves, no file locations or anything like that needed.
Sounds: https://www.youtube.com/watch?v=5yrFdhNG2Sk
Music: https://www.youtube.com/watch?v=SB1VqLCTFpA
*Stw used to be here* (to provide context)
Tactical battle: Offers free downloads to map packs, some of which are either based on the Cannon of Star trek or Star wars with according use of the franchise's sounds and music, or directly taking Music tracks from films, such as in the zombie war map pack, which uses the halloween? theme.
Star wars and Star trek links have already been provided enough times in this post. See above for those. I will add one more thing specifically for TB though.
A variant of the halloween main theme used during the zombie house map.
https://www.youtube.com/watch?v=pT4FY3NrhGg
*Tarzan Junior used to be here. I know better now.
https://blogs.loc.gov/copyright/2019/01/publicdomain/#:~:text=Edgar%20Rice%20Burroughs'%20%E2%80%9CTarzan%20and,domain%20in%20the%20United%20States.&text=Public%20domain%20works%20are%20free,copyright%20protection%20to%20all%20works.
Tournament: Heavy use of music files, characters, and possibly move lists from fighting games such as Mortal Kombat or Street Fighter. The music files are low quality, but they sound like they're full length and clearly recognisable as taken from their respective games. Examples follow:
The following found on Street fighter II OST (video link):
https://www.youtube.com/watch?v=Ceedgl2wKbg
Ken's theme (in game):
00:07:12
Munawar's theme:
https://www.youtube.com/watch?v=LQw-a8s … B0A10F2FC6
Trek2000: Similar to Final Conflict, many sounds, and in Trek2000's case also speech files, taken from Star trek.
More of the same star trek computer sounds.
https://www.youtube.com/watch?v=5qzEQwOcPtg
Next, compare this:
https://www.youtube.com/watch?v=1ZXugicgn6U&t=53s
with these:
Trek\st10.wav
Trek\st11.wav
Trek\st12.wav
And so on.
Undead assault: Concepts, music, character voices, and sounds taken from the Call Of Duty franchise.
1: fire sail music.
https://www.youtube.com/watch?v=bOKL9qPm0rc
2: Quotes from COD zombies Kino Der Toten. I'm going to show you the Nikolai quotes as an example, but it's the same for all the other characters.
https://www.youtube.com/watch?v=AbFQSmHFeNU
Any more?
X- Wing Patrol: Star wars sounds and ship names.
I've got just one. But it says a lot. Plus that games doesn't even have many sounds to begin with.
https://www.youtube.com/watch?v=yhhR16xbErA

I used to be a knee like you, then I took an adventurer in the arrow.

2021-03-31 14:10:28

See, this is why it is very stupid to endoorce such a policy, unless we want to get rid of 80 percent of the games.

I love audiogames, a specially some offline ones like top speed.

2021-03-31 14:18:51

This list is great idea in some cases, but sometimes no.
Also, include Technoshock on this list. There are various sounds from other games too.

@3 do you know what games they're from?

I used to be a knee like you, then I took an adventurer in the arrow.

2021-03-31 14:37:47

Dear connor142
I hereby kindly ask you to, for now, remove survive the wild from the list, due to 1. the mountain music is no longer what it was since several versions now, and 2. we're currently working on an update to actually remove all vestiges of potential copyright issues.
Kind regards

A door sound is from Shades of doom, some robot sounds are from another games (part of soldier robot sound is from ESP pimball classic) and also, big damage sound is from ESP Pimball extra.
I have heard, that sound of weapons are from Counter-strike, or Half-life. I have heard It from My friends, who collected those sounds, but not for games.

please do let Jim rest piecefully, man. the guy already gone now, and nothing we can do about it. have some respect for what he've done for us. as much as we try, we're sometimes going to hear the same sounds all over the place, including mainstream game, that is. oh they also do hire  paid sounds Engineer to modify the sounds slightly. do we have that? I guess not really. I am getting tired to see the same bullshit everyday on this forum. this issue getting really ridiculous. yes I do  respect you, soun designer, but if you gonna claim the sounds yours, give us some proof.

2021-03-31 15:00:01

my God.  that unnecessary.  man, and that's how the braillemon ended.  some nintendo drool egg went over there and put an end to it.  man, some of these games are not sold, for me, ok.  now they will want to create a list with games that are copies of video games and pc games.  and I think that the community of audio gamers here in Brazil was boring.  detail.  one guy said that my friends and I were not gamers just because we hate the constant battle.  well, i think i'm more gamer than him, who started playing unbalanced crap, while i started with a dvd player with two joysticks that ran nintendo with the screwed up sound

once upon a time, a beautiful little girl who wore a beautiful red hood.  while she was passing through a forest, she was killed by Captain America.  The end...

@5 if I interpret the rules correctly (and until we've got a mod's stance on the matter), I can't remove stw until that update is actually released to the public.
@6 ok, that clears things up. Thanks. It's still pretty hard to quantify Technoshock's stolen assets vs. the other stuff on the list, but once a mod decides to weigh in I'm sure we can get this cleared up.
@7 this is exactly why I didn't include games that may have taken stuff from popular sound libraries. If I had done that, pretty much every bgt game would be on the list now.
@8 I disagree. All I want is equality for as many devs as possible. Why should all older games get a free pass to stay here until someone decides to point out their assets were stolen, just because they got released before the policy was drafted?

I used to be a knee like you, then I took an adventurer in the arrow.

2021-03-31 15:04:16

they probably can delete almost all games if you offer a good alternative, But I think you can't create a game without stolen sounds, and the game that will enjoy all

Well, you based yourself on the mountain music wich is no longer a valid argument for a while now, so unless you find more hooks, the game should by all intents and purposes be deleted from the list.

I'm in full agreement with post 2 here.
Sure if every mainstream developers started to file lawsuits on audio game developers and really kicked up a fuss, then fair enough, such a policy might be agreeable.
However as post 2 said, it'll be getting rid of most audio games, and you'll be making a mountain out of a molehill just because a few games use the same sounds as each other.
If you really wanted to be realistic about it, in my opinion the likes of Nintendo etc wouldn't even bother moaning about such things because it's not worth their time, and also they would probably spend more money taking said people to court than the price tag of the game itself :d..

Though our eyes may fail, our ears prevail!

2021-03-31 15:12:42

Why are we cooperating in this venture? While there's nothing we can do to stop the mods from taking this stance, we don't have to just give over and help them with it. This is a terrible policy.

Extremely sad. I really like what Liam said about this on one of his streams actually. He was talking about how some games are just designed with their original concepts in mind and how changing them would defeat the whole point. He gave his Duck hunt game as an example, which is a really good one.
On this list, a few are present as well, such as clash of lightsabers and Sarah. Changing those breaks the entire game.
Good luck to everybody who has to sort out and deal with all this unnecessary mess.

2021-03-31 15:17:33 (edited by Stealthy 2021-03-31 15:23:27)

This is going to ruin the forum.
Seriously, I'm not sure you mods have comprehended how destructive this is going to be.
Let's be honest, 90% of game contain stolen sounds, this is meant to be a audiogames forum
I understand the mods are trying to protect the forum from being taken down, but htis in a way keeps the forum up but removes all it's content effectively killing it.

I am in no way against the mods, but I really feel this is going to be what ends the forum, or makes it a lot less popular.
We're no longer going to be able to use the audiogames forum to find games we might enjoy playing, that honestly defeats the purpose.
To conclude this glum post, I think somebody needs to start another forum.

ehh remember this is not an official list.
but if people starts chucking games to the fire knowingly, its their fault.
mods arent going to hunt old games as they've said before

2021-03-31 15:35:14

Not just forum, but also this database.
But, to be honest, this forum will ruined by some mob, who isn't happy with everything. I use a term internet mob. Those are people, who isn't happy with anything, have strange suggestion and comments full of hatred ETC. For example many people hates those subscriptions via mail, but It was good for me, because I can filter those messages by using Thunderbird, or sometimes unsubscribe from various topics.
Nextly, most of good audio game developers are not on this community, because of those internet mob, who is actually here and they want to do bad things. Nextly, from those internet mobs We have a "great developers" (It is in quotations), who create absolutely new games by cloning and breaking various codes.
Due to this and various things I have planned to leave this community, because It'll be soon destroyed. One example is also this list and maybe around 90% games will be removed from this list. It is same, as reporting people in various dictatorships by various mounster processes. I think, there were also such lists, like this. I understand idea of this list, but It is also further step to destroy most of database at Audiogames.net.
This is just My point of view about this thing. Also, I admire Connor for creating list of incremental games, but this list can destroy maybe everything of this community, this site and this forum.

Ja volim samo kafu sa Rakijom.

yeah, this thread is frankly retarded. just no. Stop.

Take care, it's a desert out there.

2021-03-31 16:38:59

Agreed with @2. This is fucking ridicolous.
Let me say some things about some of the entries on your list:
Beatstar: What do you expect? The packs are user-created, so of course there may be copyrighted stuff in there.
Light battles: It's a fucking Star Wars game, what do you think he should have done? And if he had licensed the sounds, I am sure you'd have been the first one to bitch about the game being paid.
Same goes for the Sarah game, it would just destroy the concept of the game.
I am sure I could think of arguments about most of the other entries on your list, but I don't really consider that bullshit worth my time.
To the person who mentioned what Liam said about this in his stream: Which one was it? I'd like to listen for myself.

Lastly, I think the idea behind this new policy isn't bad. The problem with it here is just that, as some others have said, most of the games we have contain lifted sounds in some form.

Greetings and happy gaming, Julian

Here's something I don't get: if one is allowed to use small titbits on youtube, why is it a problem in games. I can get music tracks, but like small fragments of Homer screaming something, or whatever else...

sure then, Let me contact nentendo or whatever company and find something else that uses stolen sounds from them and tell them hey, Those blindies are idiots, They don't respect your work, So you better not respect them as well and not make games accessable or think about letting it be a bit accessable for them because they shouldn't have them since they didn't respect your work, I guess that's what you want you people who wines about why this and why that, Correct?
You see when you see a cloner somewhere else and you look at him like a child that just does mess and stupid things? I bet if someone looked at this forum from the sighted mainstream developers and saw all of what people thinks about those stolen  content, They'll look at you exactly, Like, That.

2021-03-31 16:51:53

@connor142, while sad, I agree with your action. Policy is policy, with all consequences included. Is this going to help the forum? I doubt it. However, the lack of action will increase the general sentiment of hypocrisy, see the old "Crazy Party is still here" argument. I do have a question about Beatstar, though. Does the game officially have stolen assets when it is downloaded? If so, yes, it should be on your list. However, if you had to go out of your way (download packs) to receive copyrighted sounds, is that really the forum's fault? After all, we are linking to *only* the base game and not the pack center, are we?

2021-03-31 16:59:13

@20 TBH I don't remember, I think the first QNA he did recently but I am not entirely sure on that. I can look it up a little later though. Someone basically asked what he thinks about the new rules regarding assets.

2021-03-31 17:14:10

@22: Agreed. As long as the original games are not accessible, blind people will have to create their own version of it, in one way or another. And what other than taking the original sounds from the inaccessible as I already said, the same people who whine about stolen sounds will whine about the game's price tag then.
@Amerikranian: I think when you download Beatstar, it only downloads the default pack (which is I think 100% original), I could be wrong though.game should an audiogame dev do? Sure, he could create his own sounds, but

Greetings and happy gaming, Julian
